In response to the U.S. Administration’s announcement of the Affordable Clean Energy plan, a replacement for the Clean Power Plan, Peabody issued the following statement:

Peabody has long supported a quality replacement to the prior CPP as a significant step in increasing regulatory and investment certainty. We, along with multiple other parties, opposed the original CPP as being flawed on economic, environmental and legal grounds. 

While we are still reviewing the draft, Peabody believes that any proposed replacement rule must recognize the need for reliable, resilient and affordable electricity, and it also must accommodate technology investments including the reasonable upgrade of power plants by reforming the New Source Review program that disincentivized plant owners from upgrading their facilities. An early review suggests that this replacement draft goes a long way to satisfying these objectives.
